Cancellation Policy

1. Overview

This Cancellation Policy governs the process and consequences of cancelling a project or service engagement with N.P Building App Private Limited. We understand that business circumstances can change, and we aim to handle cancellations fairly and transparently for both parties.

2. Client-Initiated Cancellation

You may cancel a project at any time by providing written notice to us at {EMAIL}. The following terms apply upon client-initiated cancellation: (a) Before work commences: If you cancel after signing the project agreement but before any work has begun, the initial deposit is forfeited. No further charges will apply. (b) During active development: If you cancel while the project is in active development, you will be invoiced for all work completed up to the date of cancellation, calculated at our standard daily rate, plus any non-recoverable third-party costs incurred on your behalf. Any amount already paid that exceeds the cost of work completed will be refunded within 30 days. (c) After project delivery: If you cancel after the final deliverables have been delivered, no refund is applicable.

3. Notice Period

We request a minimum of 30 days' written notice for cancellation of active projects. This notice period allows us to wind down work in an orderly manner, prepare handover documentation, and reallocate resources. If you require an immediate cancellation, we will do our best to accommodate your request, but the full notice period may still apply for billing purposes.

4. Company-Initiated Cancellation

We reserve the right to cancel a project engagement in the following circumstances: (a) non-payment of invoices after reasonable notice; (b) a material breach of the project agreement or these Terms by the client; (c) circumstances beyond our control that make it impossible to continue the project (force majeure); or (d) if continuing the project would require us to act in a manner that is unethical or unlawful. In the event of company-initiated cancellation without cause, we will refund any payments received for work not yet completed.

5. Handover Upon Cancellation

Upon cancellation of a project, we will provide you with all work completed to date, including source code, design files, documentation, and any other project assets, within 14 days of the cancellation date, subject to receipt of all outstanding payments. We will also provide a brief handover document to assist you or another developer in continuing the project.

6. Ongoing Maintenance Contracts

If you have an ongoing monthly maintenance contract with us, you may cancel it by providing 30 days' written notice. Monthly maintenance fees are not refundable for the current billing period. Cancellation will take effect at the end of the notice period.

7. Effect of Cancellation

Upon cancellation: (a) all licences granted to you for work in progress (not yet fully paid for) will terminate; (b) you must cease using any deliverables for which full payment has not been received; (c) both parties will be released from their future obligations under the project agreement, except for obligations that survive termination (such as confidentiality and payment for work completed).
